1. About these terms

This website is run by SpringPad, LLC, a Nebraska limited liability company located at 1301 Garret Lane, Lincoln, NE 68512.

In these terms, "SpringPad," "we," and "us" mean SpringPad, LLC. "You" means the person using this website. "The site" means springpad.com and everything on it.

By using the site, you agree to these terms. If you do not agree with them, please do not use the site.

2. What these terms cover

These terms cover your use of this website. That means browsing it, reading it, and sending us information through it.

They do not cover membership, use of our space, or anything you buy from us. Those are covered by a separate agreement that you sign or accept when you purchase. Nothing on this website is a contract for space, and nothing here changes an agreement you have already signed with us.

3. Changes to these terms

We may update these terms from time to time. When we do, we will post the new version here and change the date at the top. If you keep using the site after we update them, you are accepting the new version.

4. Information on this site

We work to keep this site accurate and up to date, but everything on it is general information only. Prices, availability, amenities, hours, photos, floor plans, and descriptions can change at any time, and they may contain mistakes.

Nothing on this site is a firm quote or a promise that something is available. We confirm prices and availability in writing when you book or buy.

5. How you may use this site

You agree that you will not:

• Use this site for anything illegal, or in any way that breaks these terms.
• Try to break into any part of the site, our servers, or any system connected to them.
• Interfere with the site or disrupt how it works.
• Use bots, scrapers, or any automated tool to access, monitor, or copy the site without our written permission.
• Try to take apart or copy the code behind the site.
• Copy, republish, resell, or make money from our content without our written permission.
• Send us or upload anything containing viruses or harmful code.
• Pretend to be someone else, or lie about what company you represent.
• Send us content that is illegal, threatening, harassing, hateful, obscene, or that belongs to someone else.

If we have good reason to believe someone is breaking these rules, we may block their access to the site.

6. Forms and things you send us

When you fill out a contact form, request a tour, sign up for our newsletter, or send us anything else through the site, you are confirming that the information is accurate and that you have the right to send it.

You still own whatever you send us. You are giving us permission to use, store, and copy it so we can respond to you and run our business. If you send us a review or testimonial meant to be published, that permission also covers displaying it and using it in our marketing.

We do not have to publish or keep anything you send, and we can remove it at any time.

7. Our content and brand

Everything on this site, including the words, images, logos, photos, layout, and code, belongs to SpringPad, LLC or the companies that license it to us. It is protected by copyright and trademark law.

The SpringPad name and logo are our trademarks. Please do not use them without our written permission.

You may view and use this site for your own personal or business purposes. That is the only permission we are granting.

8. Links to other companies

This site links to and works with services run by other companies, including our member management and booking system and our payment processor. When you use those services, that company's own terms and privacy policy also apply to you.

We do not control those companies and we are not responsible for their content, products, or practices. We link to them for convenience, not as an endorsement.

9. Privacy

Our Privacy Policy explains what personal information we collect and how we use it. It is part of these terms. Please read it.

10. Emails and texts

If you give us your email address or phone number through this site, you are agreeing to let us reply and follow up about what you asked us.

We only send marketing emails and texts to people who have opted in. You can unsubscribe from marketing emails using the link in any message, and from texts by replying STOP. Your carrier's message and data rates may apply.

11. Site availability

We cannot promise that this site will always be available or that it will always work correctly. We may change, pause, or shut down any part of it at any time without notice.

12. No guarantees

We provide this site "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind about it, either stated or implied. That includes any implied warranty that the site is merchantable, fit for a particular purpose, free of defects in title, or does not infringe anyone's rights.

We do not promise that the site will be uninterrupted, timely, secure, or error free, that we will fix any problem, or that the site is free of viruses or other harmful components.

Some states do not allow certain warranties to be excluded, so parts of this section may not apply to you.

13. Our liability is limited

To the fullest extent the law allows, neither SpringPad, LLC nor its owners, officers, employees, contractors, or agents will be responsible for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this site. That includes lost profits, lost revenue, lost data, lost business, and damage to reputation. This applies no matter what legal theory the claim is based on, and it applies even if we were told those damages were possible.

If we are found responsible for something despite the above, our total responsibility for all claims relating to these terms or this site will not exceed one hundred dollars ($100).

Nothing in these terms limits any responsibility that the law does not allow us to limit. Some states do not allow certain limits on liability, so parts of this section may not apply to you.

14. If your actions cause us a legal problem

If someone brings a claim against us because of how you used this site, because you broke these terms, because you broke the law or violated someone else's rights, or because of something you sent us, you agree to cover our resulting costs. That includes any losses, damages, and reasonable attorney fees, and you agree to defend us against that claim.

15. Which laws apply

Nebraska law governs these terms, without regard to conflict of laws rules. Any dispute about these terms or this site must be brought in a state or federal court located in Lancaster County, Nebraska, and you agree that those courts have authority over you.

16. Other terms

These terms and our Privacy Policy are the complete agreement between you and SpringPad about your use of this site.

If any part of these terms turns out to be unenforceable, only that part is narrowed or removed. Everything else stays in effect.

If we do not enforce part of these terms right away, we can still enforce it later.

You cannot transfer these terms to someone else. We can transfer them if our business is sold, merged, or reorganized.

Sections 6, 7, 12, 13, 14, 15, and 16 continue to apply even after you stop using the site.
